Terms and Conditions of Use – Medimyth

Welcome to Medimyth, a digital platform operated by Medimyth, hereinafter referred to as “Medimyth,” “we,” “our,” or “us.” These Terms and Conditions govern your use of our website, services, and any related applications provided by Medimyth.

By accessing or using Medimyth, you (“User”, including both Doctors and Patients) agree to abide by these Terms and Conditions.

1. Services Provided by Medimyth

Medimyth is an online scheduling platform that facilitates:

  • The creation and management of doctor profiles.
  • The creation of doctor availability schedules.
  • The booking of appointments by patients without the need for registration or login.

Note: Medimyth does not provide any medical services or health advice. We are only a facilitator of appointment bookings between doctors and patients.

2. Eligibility to Use

  • Doctors must be legally qualified medical professionals and provide valid medical registration/license numbers issued by the appropriate Medical Council in India.
  • Patients must be legally competent to contract under Indian law or be assisted by a guardian.

3. Doctor Profile and Credential Verification

3.1 Profile Creation:

Doctors are required to create a profile with the following minimum information:

  • Full Name
  • Specialty
  • Clinic/Practice Details
  • Medical Registration Number
  • Consultation Location & Schedule

3.2 Verification Process:

Medimyth performs a manual verification of the registration number against public databases or requests supporting documentation. We reserve the right to approve or reject any doctor profile at our sole discretion.

3.3 Doctor Responsibilities:

  • Information provided must be truthful, current, and accurate.
  • Any attempt to impersonate or misrepresent credentials will result in permanent removal and may involve legal action.

4. Patient Appointment Booking

4.1 Booking Without Login:

Patients can book appointments without logging in or creating an account. To do so, patients must provide:

  • Full Name
  • Contact Number
  • Reason for Visit (optional)

4.2 Confirmation Process:

An OTP (One-Time Password) will be sent via SMS and/or email for verification during booking. Upon successful verification, a confirmation will be sent.

5. Platform Fee and Payment

5.1 Charges:

Medimyth collects a small platform convenience fee at the time of booking to cover operational and service-related costs.

5.2 No Doctor Fee Collected:

Medimyth does not collect any consultation or service fees on behalf of the doctors. Any such payments, if applicable, are to be made directly at the time of consultation as per the doctor's terms.

5.3 Refund Policy:

All platform fees collected are non-refundable under all circumstances, including:

  • Doctor unavailability
  • Patient cancellation or no-show
  • Errors in booking by the patient

Please make bookings only after careful review of the doctor’s schedule and your availability.

6. Communications and Notifications

6.1 What We Send:

Medimyth sends the following communication to users:

  • OTPs for booking authentication
  • Appointment confirmations
  • Appointment cancellation notices (if any)
  • Important service updates related to booked appointments

These are sent via SMS and/or Email.

6.2 No Marketing Messages:

We do not send promotional or marketing communications to users. Your contact information is only used for service-related messages.

7. Doctor Responsibilities and Conduct

Doctors using the Medimyth platform agree to:

  • Only provide lawful and ethical medical services.
  • Be present for scheduled appointments.
  • Maintain patient confidentiality and professional standards.
  • Update availability schedules promptly.

Doctors may be suspended or permanently removed from the platform if they:

  • Provide false information
  • Commit any professional misconduct
  • Engage in illegal or unethical behavior
  • Repeatedly miss or cancel scheduled appointments

Final decisions regarding removal are made solely by Medimyth’s internal compliance team.

8. Limitation of Liability

  • Medimyth is not responsible for the outcome of any medical consultation.
  • We do not guarantee the availability, punctuality, or service quality of any doctor listed.
  • All medical advice, diagnosis, and treatment are solely the responsibility of the doctor. Medimyth plays no role in the content or quality of the medical service provided.
  • Medimyth is not liable for any damages, losses, or injuries resulting from medical negligence or any interactions between users and doctors.

9. Use of the Platform

You agree:

  • Not to use the platform for unlawful purposes.
  • Not to access, collect, or download data using bots or scripts.
  • Not to interfere with or damage the platform's servers, networks, or features.

Violation of these terms may lead to permanent banning and/or legal action.

10. Intellectual Property Rights

All content, including text, graphics, logos, icons, software, and interface design, is the exclusive property of Medimyth or its licensors. You may not reproduce, copy, modify, distribute, or use any part of the website content without prior written permission from Medimyth.

11. Privacy Policy

Our Privacy Policy explains how we collect, use, store, and protect your personal information. By using Medimyth, you agree to the terms outlined in the Privacy Policy.

12. Modification of Terms

Medimyth reserves the right to update or modify these Terms and Conditions at any time. Users are responsible for reviewing these terms periodically. Continued use of the platform after changes are posted constitutes acceptance of those changes.

13. Governing Law and Jurisdiction

These Terms are governed by and construed under the laws of India. All disputes arising from the use of this platform shall be subject to the exclusive jurisdiction of the courts located in Kolkata, India.

Doctor Agreement – Medimyth

This Doctor Agreement (“Agreement”) is made between Medimyth (“Platform,” “we,” “us,” or “our”), operated by Medimyth, and the Doctor (“you,” “your,” or “Doctor”) who registers to offer appointment slots through the Medimyth platform.

By registering and creating a schedule on Medimyth, you agree to the following terms:

1. Eligibility and Registration

1.1 You confirm that you are a licensed and practicing medical professional in India and hold a valid registration/license number issued by the appropriate Medical Council.

1.2 You agree to provide accurate personal and professional information, including but not limited to:

  • Full Name
  • Medical Registration Number
  • Clinic Address and Contact Details
  • Specialization and Experience

1.3 You understand and agree that Medimyth may verify your credentials from public or official sources or request documentation before approval.

2. Use of Platform

2.1 You may use the Medimyth platform solely for the purpose of:

  • Creating your doctor profile
  • Publishing your available schedule
  • Accepting patient appointments

2.2 You are solely responsible for managing your availability and ensuring that scheduled appointments are honored unless cancelled in advance for valid reasons.

2.3 You agree that Medimyth is a facilitator only and does not provide any medical advice or services directly.

3. Platform Fee and Payments

3.1 Medimyth collects a non-refundable platform fee from patients at the time of appointment booking.

3.2 You understand that Medimyth does not collect consultation fees on your behalf, and any such transactions must occur directly between you and the patient.

4. Communication and Patient Privacy

4.1 You will only receive limited patient data (name, contact number, appointment time) after an appointment is booked.

4.2 You agree to maintain strict confidentiality and comply with all applicable medical ethics and privacy laws.

5. Code of Conduct and Compliance

5.1 You agree to:

  • Maintain professionalism and punctuality
  • Avoid any unethical or misleading medical claims
  • Not misuse the platform for illegal or fraudulent activities

5.2 Medimyth reserves the right to suspend or permanently remove your profile from the platform in the event of:

  • Misrepresentation of credentials
  • Patient complaints or professional misconduct
  • Violation of any terms herein or relevant medical laws

6. Indemnity and Liability

6.1 You agree that all medical advice, diagnosis, and treatment offered to patients are your sole responsibility.

6.2 Medimyth shall not be held liable for any claim, loss, or dispute arising from a medical services rendered by you.

6.3 You indemnify and hold harmless Medimyth from any legal action or damages arising from your use of the platform or your conduct as a medical practitioner.

7. Term and Termination

7.1 This Agreement shall remain valid as long as you continue using the Medimyth platform.

7.2 Either party may terminate this Agreement by giving written notice.

7.3 Medimyth reserves the right to suspend or terminate your account immediately in case of:

  • Breach of terms
  • Legal issues or regulatory action
  • Verified misconduct or complaints

8. Governing Law

This Agreement shall be governed by and construed under the laws of India, and any dispute arising out of this Agreement shall be subject to the exclusive jurisdiction of the courts in Kolkata, India.

9. Acknowledgment and Acceptance

By clicking “Accept” or submitting your profile on the Medimyth platform, you acknowledge that you have read, understood, and agreed to this Doctor Agreement.
